The following Terms and Conditions apply to our own products.  We are not responsible for products purchased via links to online affiliate stores like Amazon and Botanica Health.  When purchasing products on Amazon via the links on our website your customer data and rights are protected by Amazon.  You can find Amazon’s Privacy Notice here and the customer rights here. Similarly, when purchasing products via the links onsite to  Botanica Health’s store your data and customer rights are covered by Botanica’s Terms and Conditions.  You can find the store’s Privacy Notice here and the Terms and Conditions of purchase here.  We recommend you take a look at these documents before purchasing.

2.  Make A Contract With Us
2.1 When you place an order with us, you are making an offer to buy goods. Once we receive your order, we will send you an e-mail to acknowledge receipt. Acceptance of your offer to buy the goods will only take place once your payment has been received.  Only then will you receive your acceptance e-mail. It is at this point that a binding legal contract is created and any contract is subject to these Terms and Conditions.

2.2  The goods are subject to availability.In the unlikely event that the goods are no longer available, or that we have made a pricing mistake, we will advise you of this.  Should this situation arise, you will be e-mailed and given the opportunity to cancel your order or choose an alternative.  You will not receive an e-mail confirming acceptance of your order, unless you choose an alternative product, and there will be no contract between us.

2.3 Images of products on this website are for illustrative purposes only. Your goods may vary slightly from the image shown on the website and will not include any of the pictured accessories, unless stated in the specification of the goods.

2.4 Whilst we try to be as accurate as possible, all information provided is approximate and is provided in good faith.

2.5 This contract is covered by English law.

2.6 By placing an order with us, you agree to and accept these terms, as well as our privacy policy and the terms of website use.

3.  How To Place An Order
3.1 You can use our website to place an order by selecting the product you wish to buy and adding it to your basket. Items you do not require can be removed from your basket at any time.

3.2 The buyer assumes responsibility for the goods being suitable for the purpose for which they are being purchased.

3.3 Postage charges will be shown prior to you placing your order.

3.4 You will be required to pay for the goods in full at the time of ordering.

3.5  We may change these terms of sale without notice to you in relation to future sales.

3.6 We use Pay Pal and Stripe for online purchases.  PayPal supports a large number of credit cards such as:

  • Visa / Delta / Electron
  • MasterCard / Eurocard
  • Maestro
  • American Express

Debit cards are accepted if they have a Visa or MasterCard logo.

3.7 Promotional prices only apply during the period stated.

3.8 All prices quoted on our website are in UK pounds and include Value Added Tax at the current rate.

3.9 Once your order has been confirmed, changes may not be possible or may incur additional charges or delays.

3.10 Once your order is complete you will be notified by email that your order has been received for processing.

4.  Description And Price Of Goods
4.1 All prices are quoted in £ sterling inclusive of VAT and exclusive of delivery.

4.2  Every effort is made to ensure that prices shown on the website are accurate at the time you place your order. If an error is found, we will inform you as soon as possible and offer the option of reconfirming your order at the correct price, or cancelling your order. If we do not receive an order confirmation within 14 days of informing you of the error, the order will be cancelled automatically. If you cancel, then we will refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods.

4.3. In addition to the price, you will be required to pay a delivery charge for the goods.

4.4  We will be entitled to refuse to accept your order if we feel it necessary, in which case we will e-mail you as soon as we can to let you know.

5.  Payment
5.1 Payment for the goods and delivery charges can be made by any method shown on the Pay Pal web site at the time you place your order.   Payment shall be due before the delivery date and time for payment shall be of the essence.

5.2 There shall be no delivery until cleared funds are received.

6.  Delivery And Carriage Charges
6.1  We aim to process and dispatch your order within 48 hours.  All orders are packaged with great care to ensure safe delivery. Obviously, we cannot be held responsible for delays in the postal services or for reasons outlined in point 6.10which are out of our control. Please also consider Public Holiday closures.

6.2 Your order may arrive in more than one delivery.

6.3 We can deliver to the UK and Republic of Ireland.  If you are ordering from a location outside of the UK and Republic of Ireland please get in touch first before placing your order.

6.4  We will arrange for delivery of the products you order by Royal Mail to the address you specify in the checkout procedure. However, the time for the delivery will not be essential to the contract between us.

6.5  If you do not take delivery of the products or supply inadequate delivery instructions, we may cancel your order and retain the products. In this event, we will refund the price of the products, but you will still be liable to pay any delivery charges.

6.6  If there is an error or any other delivery problem in respect of the products ordered, you must notify us in writing via the e-mail address within 7 (seven) days of receiving order confirmation. We will not be liable for any loss or damage if you fail to do this.

6.7  If you change the delivery address once the goods have been dispatched to you, we reserve the right to pass on any extra charges made by our carriers for redirecting your delivery, if the carriers are able to make the change. This will delay your delivery.  We will not be responsible for any lost packages which are incorrectly addressed due to customer error.

6.8 Please check the goods on delivery – any goods found to be missing or damaged – we must be notified with in three (3) working days of receipt of your purchase.

6.9  If the goods are lost or damaged please report this to us within three (3) working days from the delivery day.

6.10 Sometimes, for reasons beyond our control, we may be prevented from delivering your goods as planned. These might include things such as accidents, breakdowns, fire, flood, storm, severe weather, acts of god, war, riot, civil commotion, malicious damage or the default of our suppliers. We are not responsible where this causes a delay or failure in delivering your goods.

6.11 All deliveries are subject to stock availability.

7.  Postage And Handling Charges
7.1 Deliveries within the UK are dispatched by First Class Royal Mail for all parcels weighing under 1 kilo. Packages weighing above 1 kilo will be posted out 2nd Class.

7.2 Any parcels above the value of £100 will be sent Royal Mail 2nd class signed for or by courier.

7.3 Postage and handling within the UK is charged at £3.95.

7.4 Orders are posted out Monday to Friday and any orders placed on Saturday or Sunday will go out the following Monday.

7.5  We reserve the right to increase postage costs at any time.  Postage costs are displayed when placing an order.

8.  Cancellation And Returns
8.1 You can cancel your contract at any time up to 30 days after the day of delivery. To do this, please email us immediately at providing us with your order number, postcode and contact number.  We will then provide the next steps and return the goods unopened and in good condition.

8.2 You do not have to give any reason for cancellation. However, a brief explanation will help us to improve the service we offer to customers in the future.

8.3 If you cancel, you must return the goods within 14 days of cancellation, complete with the original packaging to us (or any other UK address specified by us), at your own expense. You must ensure that the goods are packaged adequately to protect against damage.  We recommend that you obtain proof of postage for the return.

8.4  We will happily provide a full refund (less the cost of postage) on items returned to us within 30 days of receipt of the order if the product is unopened and in good condition.  Products should be returned to: Done Counting Sheep Ltd, Unit 21, 23 Mount Pleasant Road, Tunbridge Wells, TN1 1NT

8.5 We reserve the right not to replace any item that has been opened (indicated by the tamper seal being broken) and/or used, as we will deem this acceptance of the goods and/orfor health and hygiene purposes.

8.6 Any products that reach customers damaged or opened should be returned to us as soon as possible.  Customers must let us know by email at hello@donecountingsheep.comand provide us with photographs so we can let our postal service know that there has been a glitch on their part.  A full refund or exchange will then be made once the damaged goods have been received.

This cancellation policy does not affect your legal rights – for example, if goods are faulty.

9.  Faulty Goods / Guarantee
9.1 If there is a problem with the goods, please notify us by email providing details of the problem within 3 (three days) of receiving the goods.

9.2 If an exchange is necessary, this will be arranged without unreasonable delay and without charge. Replacement goods will not be dispatched until the original goods have been received by us and checked.

The cost of returning goods to us is your responsibility, however on inspection we will refund your reasonable postage costs, providing that the goods are found to be faulty. If the goods are not faulty, we will return them to you, however you will be required to cover our reasonable postage costs.

9.3  If our products or company fall short of our promises we kindly ask that you contact us first by email and give us the opportunity to put it right to the best of our ability.

10.  Liability
10.1 The products sold on this website have been designed to comply with all relevant UK legislation. We cannot warrant or represent that they comply with any legal requirement outside the UK.

11.  Medical Disclaimer
11.1 All information given is not intended to diagnose, treat or cure any condition or individual. If you are using supplements you should always inform your professional health practitioner.

11.6 If any part of these Terms and Conditions are declared void for unfairness pursuant to the Unfair Terms in Consumer Contract Regulations 1999, the remaining contract shall only continue to bind the parties if it is capable of continuing in existence without the unfair terms.

12.1 If we should fall short of our promises, and everyone makes mistakes sometimes, we kindly ask that individuals first contact us directly to give us the opportunity to put it right to the best of our ability.
